DIRECTIVES FOR ENFORCEMENT OF REGULATION OF THE MINISTER OF TRADE
NO. 26/M-DAG/PER/12/2005 ON RULES ON EXPORT OF COFFEE

Considering:

In View of:

1. Regulation of the Minister of Trade No. 01/M-DAG/PER/3/2004 on Organization and Operational Procedure of the Ministry of Trade;

2. Regulation of the Minister of Trade No. 17/M-DAG/PER/9/2005 on Issuance of Certificate of Origin for Indonesia's Export Commodities;

3. Regulation of the Minister of Trade No. 26/M-DAG/PER/12/2005 Rules on Export of Coffee;

DECIDES:

To Stipulate:

REGULATION OF THE DIRECTOR GENERAL OF FOREIGN TRADE ON DIRECTIVES FOR ENFORCEMENT OF REGULATION OF THE MINISTER OF TRADE NO. 26/M-DAG/PER/12/2005 ON RULES ON EXPORT OF COFFEE.

Article 1

Hereinafter referred to as:

Article 2

(1) Export of coffee may only be operated by fax coffee exporter after obtaining License of Export of Coffee (SPEK) and Certificate of Origin of ICO from the agency in charge of trade affairs in the province/regency/municipality.

(2) Coffee exported must comply with the standard of quality stipulated by the Minister of Trade.

Article 3

(1) The region of the agency in charge of trade affairs in the province/regency/municipality that can be stipulated ad the SPEK issuing institution must have the following qualifications:

(2) The provisions of paragraph (1) clause b are not applicable to Central Aceh Regency.

Article 4

The provisions regarding the institution authorized to issue Certificate of Origin of Coffee are as meant in Article 2 paragraph (3) of Regulation of the Minister of Trade No. 17/M-DAG/PER/9/2005 on Issuance of Certificate of Origin for Indonesia's Export Commodities.

Article 5

The provincial/regency/municipal agency as meant in Article 3 of this Regulation must submit report on realization of issuance of SPEK within not later than one (1) month after issuance of SPEK to the Director General of Foreign Trade via the Director for Export of Agriculture and Forestry Products.

Article 6

(1) The Coffee exporter as meant in Article 1 paragraph 2 must submit report on activities and realization of export of coffee in writing once in every three (3) months to the Director General of Foreign Trade via the Director for Export of Agriculture and Forestry Products based on the coffee year.

(2) The report as meant in paragraph (1) must have been submitted within not later than October 10, January 10, April 10, and July 10.

(3) The format of the report on activity and realization of export of coffee is as specified in Attachment two (II) to this regulation.

Article 7

The provincial/regency/municipal agency as meant in Article 5 that not reporting the realization of issuance of SPEK, its certificate of SPEK issuing institution may be reviewed.

Article 8

Certified of Exporter of Coffee will be frozen if :

Frozen Certificate of Exporter of Coffee as meant in Article 8 can be re-activated if:

This regulation is valid from the date it is stipulated.
